Reminder: Before using any services provided by Guance ("the Services"), please carefully read and thoroughly understand this declaration.
You may choose not to use the Services, but if you do, your usage will be deemed as acceptance of all the contents of this declaration. Guance refers to the website operated by Guance Information Technology Co., Limited (hereinafter referred to as "Guance"), with the domain name www.guance.one.
Guance does not monitor, preview, edit, filter, or review any information provided, uploaded, sent, posted, published, disseminated, or shared by its members on or through the Guance platform, or related to the Services. Guance is not responsible for the accuracy, legality, integrity, and/or quality of any such content, nor does it endorse, guarantee, or provide any other assurances regarding such content.
Intellectual Property Statement¶
You own the intellectual property rights to all information (including personal information), text, images, audio, videos, and other content you provide (in any format). Guance owns the copyright to the content of the Guance website related to the Services (including but not limited to text, images, software, audio, video), as well as all products, technologies, and programs of Guance. Authorized browsing, copying, printing, and dissemination of the content within the Guance website must not be used for commercial purposes, and all use of the content or any part thereof must include this copyright statement.
Guance, other product service names of Guance, and related graphics and logos are registered trademarks of Guance. Without the permission of Guance, no one may use them (including but not limited to: illegal copying, dissemination, display, mirroring, uploading, downloading). Otherwise, Guance will pursue legal responsibility.
Privacy Policy¶
Guance respects and protects the personal privacy rights of all users of the Services. To provide you with more accurate and personalized services, Guance will use and disclose your personal information in accordance with this privacy policy. However, Guance will treat this information with a high degree of diligence and caution, ensuring your privacy and the security of your personal data, in compliance with (especially and where applicable) the Personal Data (Privacy) Ordinance, Chapter 486 of the Laws of Hong Kong. Except as otherwise provided in this privacy policy, Guance will not disclose or provide this information to third parties without your prior permission.
Guance may update this privacy policy from time to time. By agreeing to the Guance service agreement, you are deemed to have agreed to all the contents of this privacy policy. This privacy policy is an integral part of the Guance service agreement.
Scope of Application¶
- When you register a Guance account, the personal or organizational registration information you provide as required by Guance;
- When you use the Services or visit the Guance website, Guance automatically receives and records information on your browser and computer, including but not limited to your IP address, browser type, language used, access date and time, software and hardware characteristics, and the web records you request;
- User personal data obtained by Guance through legal means from business partners.
You may choose whether to provide the above personal information, but when the required service is personalized, or the provision of the service is based on your having provided all necessary personal information, if you fail to provide the required personal information, it may hinder Guance from providing you with such specific services.
You understand and agree that the following information is not subject to this privacy policy:
- Information you publish when using the bulletin board service (BBS) provided by Guance;
- Information you disclose when using the Services provided by Guance;
- Credit evaluations, violations of laws or Guance rules, and measures Guance has taken against you.
Information Use¶
- Guance may collect, retain, and use your personal information for the following purposes:
- The purposes described in this privacy policy;
- To ensure and improve the security and reliability of Guance products and services, including detecting, preventing, and responding to fraudulent activities, infringements, security risks, and technical issues that may harm Guance, our users, or the public.
- When using your information for purposes not covered by this privacy policy, we will seek your consent in advance.
- Guance will not provide, sell, rent, share, or trade your personal information to any unrelated third party, unless we have obtained your prior permission, or the third party and Guance (including Guance affiliates) individually or jointly provide services to you, and after the service ends, they will be prohibited from accessing all such information that they were previously able to access;
- Guance also does not allow any third party to collect, edit, sell, or disseminate your personal information by any means. Any Guance user who engages in the above activities will be subject to immediate termination of the service agreement by Guance;
- For the purpose of serving users, Guance may use your personal information to provide you with information of interest, including but not limited to sending you product and service information, or sharing information with Guance partners (see the relevant pages of the Guance website) so that they can send you information about their products and services (the latter requires your prior consent);
- For Guance ICSP service customers, Guance will strictly keep confidential all information, plans, architectures, etc., obtained during cooperation with you. Unless you give special permission, Guance will not share such information with other third parties.
Information Disclosure¶
Under the following circumstances, Guance will disclose your personal information in whole or in part in accordance with your personal wishes or legal requirements:
- With your prior consent, disclose to third parties;
- If you are a qualified intellectual property complainant and have filed a complaint, disclose to the respondent at the request of the respondent, in order to resolve possible rights disputes;
- In accordance with relevant legal provisions, or at the request of administrative or judicial authorities, disclose to third parties or administrative and judicial authorities;
- If you violate relevant laws, regulations, or rules in Hong Kong, disclose to third parties;
- In order to provide the products and services you request, it is necessary to share your personal information with third parties;
- In a transaction created on Guance, if any party to the transaction has fulfilled or partially fulfilled its transaction obligations and requests information disclosure, Guance has the right to decide to provide the user with the contact information and other necessary information of the transaction counterparty to facilitate the completion of the transaction or the resolution of disputes;
- Other disclosures that Guance deems appropriate in accordance with laws, regulations, or website policies.
Information Storage and Retention¶
The information and data collected by Guance about you will be stored on the servers of Guance and/or its affiliated companies. If Guance collects information and data in a location where it is necessary to transfer it outside of Hong Kong for different purposes, the transfer will comply with the current provisions of the Personal Data (Privacy) Ordinance. Guance will hold your personal information in accordance with internal policies and adhere to the following principles: a. Personal information will only be retained until the original purpose of collecting such information, or a directly related purpose, is achieved, unless it must be retained in accordance with any applicable laws, regulations, or contractual provisions; and b. Based on internal procedures, personal information will be cleared from Guance's electronic, manual, and other storage systems.
Direct Marketing¶
Guance, in compliance with applicable laws, rules, regulations, and license requirements, may use your data (including but not limited to name, contact data, phone number, home/office address, email address, and data of products you have purchased), Guance, its subsidiaries, affiliate members, and associated companies, and their business partners (collectively referred to as "service providers") to provide you with direct marketing data, including sending you notifications and/or the latest information about gifts, discounts, exclusive offers, promotions, and offers related to the services provided by Guance and service providers.
Before using your personal information for the purposes described in this privacy policy, Guance may be required by law to obtain your written consent. Unless otherwise provided by law or in certain cases where exceptions apply, we will only begin to use and provide your personal data for any promotional or marketing purposes after obtaining your written consent.
Use of Cookies¶
- If you do not refuse to accept cookies, Guance will set or access cookies on your computer to allow you to log in or use Guance services or features that rely on cookies. Guance uses cookies to provide you with more thoughtful personalized services, including promotional services;
- You have the right to choose to accept or refuse cookies. You can refuse cookies by modifying your browser settings. However, if you choose to refuse cookies, you may not be able to log in or use Guance services or features that rely on cookies;
- Information obtained through cookies set by Guance will be subject to this policy.
Information Security¶
- Please keep your account and password information properly. Guance will ensure that your information is not lost, misused, or altered through security measures such as backing up to other servers and encrypting user passwords. Despite the aforementioned security measures, please also note that there are no absolutely perfect security measures on the information network;
- When using Guance services for online transactions, you will inevitably disclose your personal information to the counterparty or potential counterparty, such as contact information or email address. Please protect your personal information properly and only provide it to others when necessary. If you find that your personal information has been leaked, especially if your Guance account and password have been compromised, please contact Guance customer service immediately so that Guance can take appropriate measures.
- Customers can log in to the Guance console through a browser and perform Guance account cancellation in [Account Management]. Please refer to the "Guance Account Cancellation Notice". Except as otherwise provided by laws and regulations, after account cancellation, your information will be deleted from Guance and cannot be recovered. Please proceed with caution.
Rights to Access, Correct, and Delete Personal Information¶
Guance will take all reasonable precautions to ensure that the personal information it collects, uses, and discloses is accurate, complete, and up-to-date. You have the right to request access to and correction of your personal information. When you find any errors in your personal information records, or if your personal information has changed or been updated, please notify Guance.
If you wish to access or correct any personal information held by Guance about you, or request the deletion (only applicable if required by relevant laws) of any information that is no longer necessary for the services provided by Guance, you can log in to Guance, or contact Guance as described in "How to Contact Us" below. Guance may charge an administrative fee for accessing the information in response to your request.
Unless applicable laws allow Guance to hold or process your personal data, you may object to Guance holding or processing your personal information at any time for legitimate reasons.
Special Notes for Minors¶
If you are not a natural person who is 18 years old or older, you are not authorized to use the Services, so Guance hopes that you will not provide us with any personal information.
Updates to the Privacy Policy¶
- Our privacy policy may be revised.
- Without your explicit consent, we will not limit the rights you should enjoy under this privacy policy. We will publish any revisions to the privacy policy on a dedicated page.
- For major revisions, we will also provide more prominent notice (including for certain services, we will notify you through website announcements, explaining the specific changes to the privacy policy).
- Major changes referred to in this policy include but are not limited to:
- Significant changes in our service model. Such as the purpose of processing user information, the types of user information processed, the way user information is used, etc.;
- Significant changes in our control rights, organizational structure, etc. Such as business adjustments, bankruptcy mergers and acquisitions, etc., causing changes in ownership;
- The main objects of user information sharing, transfer, or public disclosure change;
- Your rights and how they are exercised in terms of user information processing undergo significant changes;
- The department responsible for handling user information security, contact information, and complaint channels change;
- The user information security impact assessment report indicates a high risk.
